  1. The company TLV s.r.o., ID No.: 26106191, with its registered office at Pitterova 2855/7, Žižkov, 130 00 Prague 3, registered in the Commercial Register maintained by the Municipal Court in Prague under file No.: C 161155 (hereinafter referred to as the "Controller" or "we") cares about the protection of your personal data, so please read how we process your personal data and how we handle it.

The controller processes personal data in accordance with relevant legislation, such as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 110/2019 Coll., on the processing of personal data.

  4. What personal data do we process and why do we process it?
    1. This personal data processing policy (the "Policy") applies to the processing of personal data of the following subjects:
      • of people interested in our services,
      • of customers,
      • business partners,
      • visitors to the www.gpsdozor.cz website (hereinafter referred to as the "Website"),
      • jobseekers.
  5. What personal data do we process and why do we process it?
    1. We are aware that one of the rules of the relevant data protection legislation is proportionality, which is why we process your personal data only to the extent necessary for the purpose in question.
    2. Scope of personal data processed
    3. If you are interested in our services, we process your following personal data:
      • Identifying personal data such as academic title, name, surname, date of birth, birth number, ID number, VAT number,
      • address data, such as permanent home or permanent residence address, correspondence address, registered office,
      • contact details such as email address and phone number,
      • identification data of your company, number of vehicles or other objects to be tracked,
      • the communication we have with each other.
    4. If you are our customer, we process your following personal data:
      • identifying personal data, such as academic title, name, surname, date of birth, birth number, ID number, VAT number, information on marital status,
      • address data, such as permanent home or permanent residence address, correspondence address, registered office,
      • contact details such as email address and phone number,
      • identification data of your company, bank account number, identification of issued and received invoices,
      • the number (and designation) of vehicles or other objects to be tracked, or contact details of the driver for the purpose of installing the unit,
      • data related to the driving style/movement of the tracked objects,
      • the communication we have with each other.
    5. If you are our business partner, we process your following personal data:
      • identifying personal data, such as, name, surname, ID number, VAT number,
      • address details such as mailing address, registered office,
      • contact details such as email address and phone number,
      • bank account number, identification of invoices issued and received,
      • the communication we have with each other.
    6. If you have contacted us via the contact form on the website, we process your personal data in the scope of name, surname, e-mail, telephone, company identification data and number of vehicles.
    7. When you visit our website, we also store various cookies, namely necessary cookies for the operation of the website, statistical cookies that help us to map your behaviour on the website and then improve the website and your experience, and marketing cookies so that we can subsequently show you relevant advertising.     8. If you are our job candidate, we process your personal data to the extent of the data from your CV and our communications in connection with the position applied for/offered.
    9. Purposes and legal basis of processing
    10. We process your personal data for several reasons, which we describe below. However, each of these reasons must also be supported by a legal basis for the processing in order for the processing of personal data by the company to be lawful and in accordance with the relevant legislation.
    11. Below we have prepared an overview of the so-called legal bases and purposes of processing personal data, i.e. the reasons why we process personal data.
    12. If you are our customer, we process your personal data for the purposes of:
      • the preparation, performance, registration and conclusion of a service contract and a sales contract, based on the legal title of the performance of the contract or the taking of measures prior to the conclusion of such a contract,
      • tax and accounting purposes, in particular the issuance of invoices, processing of payments, bookkeeping, based on the legal title of fulfilling the legal obligations to which the company as a data controller is subject,
      • informing you about our company news and online marketing (displaying relevant advertising based on your behaviour on the website and stored cookies) based on the legal title of the company's legitimate interests,
      • approaching potential candidates based on the legal title of the company's legitimate interests,
      • references to our services, based on the legal title of consent to the processing of personal data,
      • the management of all communications relating to contracts that we have entered into together or the conclusion of which we have facilitated, with the performance of obligations under such contracts, on the basis of the legal title of the performance of the contract or the taking of measures prior to the conclusion of such contract,
      • recovery of debts if you have not paid us what you should have paid under the contracts you have entered into with us, or protection of our rights and enforcement of our rights in any litigation, based on our legitimate interest.
    13. If you are our business partner, we process your personal data for the purposes of:
      • the preparation, performance, registration and conclusion of a contract, on the basis of the legal title of the performance of the contract or the taking of measures prior to the conclusion of such a contract,
      • tax and accounting purposes, in particular the issuance of invoices, payment processing, bookkeeping, based on the legal title of fulfilling the legal obligations that apply to the company as a personal data controller,
      • keeping internal records of business partners, based on the legal title of the legitimate interests of the controller,s
      • the fulfilment of public law obligations to which the company is subject, based on the legal title of the fulfilment of legal obligations to which the company is subject as a data controller,
      • recovery of debts if you have not paid us what you should have paid under the contracts you have entered into with us, or protection of our rights and enforcement of our rights in any litigation, based on our legitimate interest.
    14. If you have contacted us via the contact form, we process your personal data for the purposes of processing and sending you a response to your enquiry or offer, as the case may be, on the basis of the legal title of the performance of the contract and the implementation of the measures taken prior to the conclusion of the contract at your request. This is a legal concept, such a legal basis does not mean that we enter into a contract with you, when you contact us via the contact form, it is clear to us that you are only interested in something or want to discuss something or ask us to send you an offer. Furthermore, you may be informed about our company's news through online marketing (displaying relevant advertising according to your behaviour on the website and stored cookies), based on the legal title of the company's legitimate interests.
    15. If you are an applicant for employment with our company, we process your personal data for the purposes of conducting the selection procedure, on the basis of the legal title of implementing the measures taken before the conclusion of the contract at your request (even if we do not ultimately agree on cooperation).
    16. We do not use your personal data to make decisions based on automated processing or profiling.
  6. Do you have to provide us with personal data?
    1. If we are to provide you with the service you require, we will need your personal data and unfortunately we cannot do this without it. The provision of personal data is therefore a contractual requirement and we cannot enter into the relevant contracts with you and start working with you without it.
    2. If you as our future business partner wish to enter into a contract with us, we still need your personal data in order to cooperate with you and fulfil our obligations under the contract. The provision of personal data is therefore also a contractual requirement in this case and we cannot conclude a contract with you without your provision of personal data.
    3. Also, when contacting us via the enquiry or contact form, you must provide us with personal data so that we can contact you back on the basis of the enquiry or enquiry sent, providing personal data is a contractual requirement. In the case of a job applicant, providing personal data is also a contractual requirement so that we can contact you and include you in the selection process.
  7. Do you always have to give us consent to process your personal data?
    1. In some cases, we may need your consent to process your personal data. However, processing is not always based on consent and we will only require your consent where it is necessary for us to process your personal data.
    2. You consent to the processing of your personal data in connection with the processing purposes we have set out above, which have consent as their legal title. However, you may withdraw your consent at any time, free of charge, without giving any reason, by sending a written notice of withdrawal of consent to the address of the controller's registered office or by sending an email to info@gpsdozor.cz.
  8. How long will we keep your personal data?
    1. In the event that you sign any contract with us, your personal data must be retained not only for the duration of that contract, but also after we have terminated our contract. This is for example due to withdrawal from the contract, claiming damages, therefore we keep your personal data for 10 years from the conclusion of any contract, or for 10 years from the date of termination of the contract (sometimes it may happen that we withdraw from the contract if you do not fulfill your obligations under the contract or if we agree on a different termination of our cooperation and thus the contract). Therefore, we cannot delete your personal data as soon as a contract has been concluded or a service has been provided.
    2. We are also obliged under the relevant legislation to keep, for example, tax documents for 10 years from the end of the tax year in which the transaction took place, including your personal data on them.
    3. We store personal data from the enquiry and contact form for 1 year after you send us your enquiry or message via the form, unless we have established cooperation and you have become a prospect, customer or business partner.
    4. We always keep personal data for the time necessary and appropriate for the purpose, i.e. the reason why we process your personal data. The retention period is determined in particular by the following logic:
      • for the duration of the contractual obligation with you,
      • for as long as necessary to protect the rights of the company,
      • for the duration of the legitimate interests of the company, provided that such period is proportionate to the purpose of the processing,
      • for the period of time specified by law,
      • for as long as necessary to establish, exercise or defend legal claims.
  9. Do we pass on your personal data to any other parties?
    1. Only authorised employees, sales representatives and associates have access to personal data. In order to ensure our operations, we also pass your personal data to an external accountant to the extent necessary for her work, and some personal data is also accessible to our IT specialist, tax advisor, and legal advisor. We may also pass on your personal data to the relevant government authorities, public authorities or banking institutions. We may also transfer personal data to our legal representatives and other persons for the purpose of protecting our rights. All such recipients of your personal data are obliged to protect your personal data in the same way as we do, i.e. in accordance with applicable law. If these recipients process personal data as processors, we have entered into appropriate contracts with them.

  10. What rights do you have in relation to the processing of personal data?
    1. Below you will find a list of the rights you are entitled to in relation to the processing of personal data.
      • Right of access: you have the opportunity to ask us to tell you what personal data we process about you and you may be given access to this data, i.e. a copy of the personal data we process.
      • Right to repair: You can also ask us to correct inaccurate or incomplete personal data.
      • Right to erasure: You can also ask us to delete your personal data, under certain conditions we are then obliged to delete this personal data, but not always, in some cases we may continue to retain the personal data.
      • Right to restriction of processing: you also have the right to request restriction of processing under certain conditions, e.g. if you contest the accuracy of the personal data and we verify its accuracy.
      • Right to portability: you also have the so-called right to portability, i.e. you have the right to have us provide you with data in a structured, commonly used and machine-readable format under certain conditions.
      • Right to withdraw consent: Last but not least, you have the right to withdraw your consent to the processing of your personal data at any time without giving any reason.
      • The right to lodge a complaint and to effective judicial protection: If you suspect that we are violating the law or other applicable legislation in processing your personal data, you have the right to file a complaint with the Office for Personal Data Protection and the right to effective judicial protection in this area.

    2. In addition to the above rights, you have the right to object to processing relating to your particular situation, for example, if we process your personal data for our legitimate interests.

    1. You can always find out up-to-date information about the processing of your personal data through this policy. The first page shows the effective date and if we update the information in this policy, we will send you the updated version.
